NMAC. This Bulletin is issued in response to several inquiries from insurers regarding the timing of invoices that are normally issued by the Office of Superintendent of Insurance (“OSI”) to property and casualty insurance companies for the annual rates and forms filing fees. In accordance with Section 59A-6-1.2 of the New Mexico Insurance Code, annual rate and form filing fees are due in advance by July 1 of each year. OSI has administered Section 59A-6-1.2 in practice by preparing and issuing annual invoices to property and casualty companies, and in accordance with that practice the invoices are normally posted by the beginning of June or earlier. As a result of OSI’s transition to the National Association of Insurance Commissioners (NAIC) State Based System (SBS) pursuant to 2016 Senate Bill 108 (Laws 2016, Chapter 89) and other applicable law, OSI is in the process of converting to a new web based system. Due to above referenced unavoidable delays in OSI's administration of Section 59A-6-1.2, OSI will treat Property and Casualty Rate and Form Filing Fees as timely if they are paid in full as invoiced on or before August 1, 2017.
