Section 22. Penalties For Rule Violation

A. Commission sanctions: A requestor who violates the requirements of this rule may be subject to any or all of the following sanctions, as determined by the commission: (1) temporary or permanent denial of access to HIS data or reports; (2) termination of current access; and (3) mandated immediate return, without duplication, of HIS data or reports provided by the commission. B. Other penalties: A requestor who violates the requirements of this rule or the Health Information System Act, Section 24-14A-1 et seq. NMSA 1978, may be subject to sanctions provided in applicable state, federal or tribal laws or regulations, including but not limited to injunctive relief and civil penalties of up to $1,000 per violation.
