Kiser, Utah Insurance Commissioner Date: November 20, 2013 Subject: U.C.A. § 31A-22-307(1)(c) - Personal Injury Protection Coverage Funeral, Burial or Cremation Benefits The purpose of this Bulletin is to provide all insurers writing auto insurance in Utah guidance regarding the interpretation of Utah Code Annotated (U.C.A.) §31A-22-307(1)(c) by the Utah Insurance Department (Department), related to required funeral, burial or cremation benefits. U.C.A. § 31A-22-307(1)(c) states: “(1) Personal injury protection coverages and benefits include:...funeral, burial, or cremation benefits not to exceed the total of $1,500 per person...” Based on a review of the legislative history of U.C.A. § 31A-22-307(1)(c), it is the Department’s conclusion that it was not the intent of the Legislature to limit the amount of benefits or coverage offered for funeral, burial or cremation. It is, therefore, the Department’s interpretation that auto insurers in this State may offer funeral, burial or cremation benefits greater than the $1,500 stated in the statute. Form changes made pursuant to this Bulletin must be filed with the Department in accordance with U.C.A. 31A-21-201. Rate changes made pursuant to this Bulletin must be filed and justified with the Department in accordance with U.C.A 31A-19a-203. DATED this 20th day of November 2013. Todd E.
