MOST RESPECTFULLY SHOWETH: -

1.That the captioned matter is pending adjudication before this Hon'ble Court and is next listed before this Hon'ble Court for Purpose of next listing.

2.That by way of the present application, the Applicant/Accused seeks permission of this Hon'ble Court to travel outside India, i.e., to Travel destination, on account of business commitments. The Applicant is required to undertake the said journey from Travel start date to Travel end date.

3.It is pertinent to mention that the air tickets for the aforesaid journey have already been finalised and booked in advance, so as to enable the Applicant to furnish the exact details to this Hon'ble Court well in time. It is further stated that during the said journey, the Applicant shall be staying at Address of stay in Dubai, in the care of Mr./Ms. Name of contact person in Dubai.

A copy of the air tickets is annexed herewith as *Annexure A-1.*

4.That vide order dated Date of earlier order of the court, this Hon'ble Court was pleased to cancel/rescind the Look-Out Circular (LOC) issued/open against the Applicant, subject to the condition that the Applicant/Accused, Applicant/accused's name, shall not leave India without the prior permission of this Hon'ble Court. The Applicant has taken diligent steps to ensure complete compliance with the directions and conditions imposed by this Hon'ble Court.

A copy of the order dated Date of earlier order of the court passed by this Hon'ble Court is annexed herewith as *Annexure A-2.*

5.That the Applicant has already instructed and authorised his counsel to duly accept notice on his behalf, and further undertakes that the proceedings before this Hon'ble Court shall not be hampered during the period of the Applicant's travel, nor shall any inordinate delay be occasioned on account of the Applicant. The Applicant further undertakes to furnish sufficient surety before this Hon'ble Court, if so directed.

1.That the aforesaid case is pending before this Hon'ble Court, and the charge-sheet has been filed in the aforesaid FIR against the applicant / accused.

2.That there is no basis for the issuance of the LOC against the applicant / accused. It is pertinent to mention herein that notice under Section 41A of the CrPC was served upon the applicant / accused through WhatsApp or email, and the applicant has always given a reply / response to the same to the Investigating Officer of the case who issued the notice. The issuance of the LOC against the applicant is itself bad in law and violative of Articles 14 and 21 of the Constitution. The LOC, if any, pending in the name of the applicant / accused is also contrary to the objective for which an LOC may be issued.
