APPLICATION ON BEHALF OF THE APPLICANT / DECREE HOLDER FOR CANCELLATION OF THE BAILABLE WARRANT ISSUED AGAINST THE APPLICANT
MOST RESPECTFULLY SHOWETH:
1.That the present matter is pending adjudication before this Hon'ble Court and the same is listed for hearing on Date of next hearing.
2.That this Hon'ble Court, vide order dated Date of order issuing bailable warrant, issued a Bailable Warrant against the applicant / decree holder on account of his non-appearance before this Hon'ble Court.
3.That on the last date of hearing, i.e. Date of last hearing, the counsel for the applicant apprised this Hon'ble Court that the applicant was unable to appear as the new office of his company was inaugurated at Location of new office, and his presence there was indispensable as the head of the company. Despite the same being explained, this Hon'ble Court was pleased to issue a Bailable Warrant against the applicant.
4.That the non-appearance of the applicant before this Hon'ble Court was neither intentional nor deliberate, but occurred for the reasons stated above. It is therefore most respectfully prayed that the Bailable Warrant issued against the applicant be cancelled and his non-appearance be condoned in the facts and circumstances of the case stated above.
5.That the present application has been filed in good faith and for bona fide purposes, and without any prejudice to the rights of the other parties. The same may therefore be allowed in the interest of justice.
6.That the applicant undertakes to remain careful and diligent in future in appearing before this Hon'ble Court on each and every date of hearing.
PRAYER
It is, therefore, most respectfully prayed that this Hon'ble Court may graciously be pleased to:
(a)cancel the Bailable Warrant issued against the applicant / decree holder in the present matter, in the interest of justice;
(b)pass such other and further order as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case, in the interest of justice.
