MOST RESPECTFULLY SHOWETH:
1.That the above-mentioned matter is pending before this Hon'ble Court and is now fixed for Next date of hearing (day).Next date of hearing (month).Next date of hearing (year).
2.That on Date of NBW issue (day).Date of NBW issue (month).Date of NBW issue (year), this Hon'ble Court was pleased to issue Non-Bailable Warrants against the applicant/accused, namely Accused's name, owing to his non-appearance before this Hon'ble Court.
3.That on the last date of hearing, i.e. Last date of hearing (day).Last date of hearing (month).Last date of hearing (year), the applicant/accused was unable to appear before this Hon'ble Court on account of his medical condition, as the accused suffers from Medical condition of the accused. While he was on his way to attend the court proceedings, accompanied by Person accompanying the accused (e.g., wife/co-accused), his condition suddenly worsened, creating an emergency situation, as a result of which they were constrained to rush back for urgent medical attention and were therefore unable to appear before this Hon'ble Court.
4.That on the last date of hearing, the counsel for the accused was also unable to appear before this Hon'ble Court, as the sudden medical emergency left Person accompanying the accused (e.g., wife/co-accused) in a state of shock, and in the commotion that ensued, the accused and his companion were unable to inform the counsel in time, communicating the same only at a later point.
5.That it is pertinent to mention here that the matter has already been Settlement status between the parties between the parties, and nothing remains to be adjudicated in the said matter. Upon completion of the payment, the applicant/accused shall pray before this Hon'ble Court for compounding of the matter.
6.That for the reasons set out above, the applicant/accused could not appear before this Hon'ble Court on the last date of hearing, i.e. Last date of hearing (day).Last date of hearing (month).Last date of hearing (year).
7.That the non-appearance of the accused was neither intentional nor deliberate, but was occasioned solely by the reasons stated above.
8.That there is no mala fide intention on the part of the applicant/accused in not appearing before this Hon'ble Court, and the applicant shall remain careful and diligent in future.
PRAYER
It is, therefore, most respectfully prayed that this Hon'ble Court may kindly allow this application and cancel the Non-Bailable Warrant issued against the applicant/accused on Date of NBW issue (day).Date of NBW issue (month).Date of NBW issue (year), in the interest of justice.
Any other order/orders which this Hon'ble Court may deem fit and proper, on the facts and circumstances of the present case, may also kindly be passed in favour of the applicant/accused.
