APPLICATION ON BEHALF OF THE APPLICANT/OWNER, NAMELY Applicant/owner's name, SEEKING RELEASE OF HIS VEHICLE (POLICE BAIL) Vehicle make and model BEARING REGISTRATION NO. Vehicle registration number ON SUPERDARI.
MOST RESPECTFULLY SHOWETH :-
1.That the captioned FIR has been registered at Police Station Police station by the Complainant on Date of registration of the FIR under Sections 279/337 of the IPC.
2.That the facts of the case are as follows:-
A.That the Applicant is the owner of the vehicle bearing registration No. Vehicle registration number. It is alleged by the Complainant that on Date of the incident, the driver of the said vehicle was driving the said vehicle and hit a motorcycle at Place of accident and fled from the spot. On Date of registration of the FIR, when the police visited the residence of the Applicant/Owner and informed him that his vehicle was involved in the said incident, the captioned FIR was registered. A copy of the FIR is annexed as Annexure A-1.
B.On Date of registration of the FIR, the police officials called upon the Applicant/Owner to produce the said vehicle along with the driver who was driving the said vehicle at the time of the said incident. The Complainant identified the driver and the vehicle of the Applicant, and upon such identification, the police officials seized the said vehicle of the Applicant.
3.That the Applicant is the rightful owner of the said vehicle. A copy of the Registration Certificate of the said vehicle is annexed as Annexure A-2. A copy of the Aadhaar Card of the Applicant is annexed as Annexure A-3.
4.That the Applicant/Owner, through the present application, seeks permission of this Hon'ble Court for release of the aforesaid vehicle, Vehicle make and model bearing Registration No. Vehicle registration number, on superdari to the Applicant, and the Applicant undertakes to produce the said vehicle as and when directed by this Hon'ble Court.
5.In view of the aforesaid facts and circumstances, coupled with the judgment passed by the Hon'ble Apex Court in Sunder Bhai Ambalal Desai Vs. State of Gujarat, AIR 2003 SC 638, the view of the Hon'ble Supreme Court has been reiterated by the Hon'ble Delhi High Court in the case titled Manjit Singh Vs. State, Crl.M.C. No. 4485/2013, decided on 10.09.2014, wherein it has been held: "Vehicles involved in an offence may be released to the rightful owner after preparing a detailed panchnama, taking photographs of the vehicle, a valuation report and a security bond.
69. The photographs of the vehicle should be attested and countersigned by the Complainant, the accused as well as by the person to whom the custody is handed over.
70. The production of the vehicle should not be insisted upon during trial. The panchnama and photographs, along with the valuation report, should suffice for the purposes of evidence.
71. Return of vehicles and permission for sale thereof should be the general norm rather than the exception."

It is, therefore, most respectfully prayed that this Hon'ble Court may kindly release the vehicle Vehicle make and model bearing Registration No. Vehicle registration number to the Applicant on superdari, in the interest of justice.
