APPLICATION ON BEHALF OF THE APPLICANT / DECREE HOLDER FOR CANCELLATION OF THE BAILABLE WARRANT ISSUED AGAINST THE APPLICANT
MOST RESPECTFULLY SHOWETH:
1.That the present matter is pending adjudication before this Hon'ble Court and is listed for hearing on Date of next hearing.
2.That this Hon'ble Court, vide order dated Date of warrant order (day).Date of warrant order (month).Date of warrant order (year), was pleased to issue a Bailable Warrant against the applicant / decree holder on account of his non-appearance before this Hon'ble Court.
3.That on the last date of hearing, i.e. Date of last hearing (day).Date of last hearing (month).Date of last hearing (year), counsel for the applicant apprised this Hon'ble Court that the applicant was unable to appear as Reason for non-appearance, and that his presence there was necessary. It was in these circumstances that this Hon'ble Court was pleased to issue Bailable Warrants against the applicant.
4.That the non-appearance of the applicant before this Hon'ble Court was not intentional or wilful, but was due to the reason stated above. It is therefore prayed that, in the facts and circumstances stated hereinabove, this Hon'ble Court may be pleased to cancel the Bailable Warrant issued against the applicant and condone his non-appearance.
5.That the present application has been filed bona fide and without any prejudice to the rights of the other parties, and the same may therefore be allowed in the interest of justice.
6.That the applicant undertakes to remain diligent and cautious in future in appearing before this Hon'ble Court as and when required.
PRAYER
It is, therefore, most respectfully prayed that this Hon'ble Court may graciously be pleased to cancel the Bailable Warrant issued against the applicant / decree holder in the present matter, in the interest of justice.
Any other order which this Hon'ble Court may deem fit and proper may also be passed in the facts and circumstances of the case, in the interest of justice.
