MOST RESPECTFULLY SHOWETH: -

1.That the captioned matter is pending adjudication before this Hon'ble Court and is next listed before this Hon'ble Court for Purpose of next hearing.

2.That vide the present application, the Applicant/Accused seeks permission of this Hon'ble Court to travel outside India, i.e., to Travel destination, on account of business commitments. The Applicant is required to travel to Travel destination from Travel start date.

3.It is pertinent to mention that the air tickets for the aforesaid travel of the Applicant have been finalised and booked in advance, so that the exact details thereof could be furnished to this Hon'ble Court in good time. It is further stated that during his travel to Travel destination, the Applicant shall be staying at Accommodation address abroad.

Copy of the air tickets is annexed herewith as Annexure A-1.

4.That vide order dated Date of earlier order, this Hon'ble Court was pleased to cancel/rescind the Look Out Circular (LOC) issued/open against the Applicant, subject to the condition that the Applicant/Accused, Accused name, shall not leave India without the prior permission of this Hon'ble Court. The Applicant has taken diligent steps to ensure complete compliance with the directions and conditions imposed by this Hon'ble Court.

Copy of the order dated Date of earlier order passed by this Hon'ble Court is annexed herewith as Annexure A-2.

5.That the Applicant has already instructed and authorised his counsel to duly accept notice on his behalf, and the proceedings before this Hon'ble Court shall not be hampered during the Applicant's travel, nor shall any inordinate delay be caused on account of the Applicant. The Applicant shall further furnish sufficient surety before this Hon'ble Court, if so directed.

MOST RESPECTFULLY SHOWETH:

1.That the aforesaid case is pending before this Hon'ble Court, and the charge-sheet has been filed in the aforesaid FIR against the applicant / accused.

2.That there is no basis for the issuance of the LOC against the applicant / accused. It is pertinent to mention herein that notice under Section 41A of the CrPC was served upon the applicant / accused through WhatsApp or email, and the applicant has always given a reply / response to the same to the Investigating Officer of the case who issued the notice. The issuance of the LOC against the applicant is itself bad in law and violative of Articles 14 and 21 of the Constitution. The LOC, if any, pending in the name of the applicant / accused is also contrary to the objective for which an LOC may be issued.
