Respected Sir / Madam,
I, Complainant's name, S/o Late Sh. Complainant's father's name, R/o Complainant's address, am the Proprietor of Complainant's firm name, having its office at Complainant's firm's office address. We are engaged in the field of education and provide career and education consultancy to students who have passed Classes 10 and 12, and guide them regarding suitable career options.
In the month of Month of first meeting with first introducer, I met Ms. First introducer's name, who resides at First introducer's address, in connection with our consultancy work. During the course of the professional conversation, Ms. First introducer's name informed me that she had another business prospect of providing jobs in Country of proposed job, and accordingly introduced me to Ms. Second introducer's name, who resided in Mumbai and used to provide jobs to candidates abroad. Ms. First introducer's name connected me with Ms. Second introducer's name over the telephone, whereupon the latter told me that she was in the business of providing work/jobs to candidates in Country of proposed job, that she currently had job openings there, and asked me to forward candidates for such work. On the persuasion of Ms. First introducer's name and Ms. Second introducer's name, I forwarded one candidate, namely Candidate's name, for work in Country of proposed job. Thereafter, Ms. Second introducer's name told me that her business partner, Mr. Co-accused's name, who resides at Co-accused's address, was handling the entire work/job process, and put me in telephonic contact with Mr. Main accused's name, Proprietor of M/s Accused's firm name.
Mr. Main accused's name told me that he had been in the business of providing jobs/work to candidates abroad for many years, and that he presently had vacancy openings in Country of proposed job. He apprised me that he currently had vacancies in M/s Company name in job offer and persuaded me to provide candidates for work there. To induce me, Mr. Main accused's name also showed me an authorisation letter dated Date of authorisation letter, executed between M/s First party to authorisation letter and Second party to authorisation letter, and assured me that the documents were genuine and that all work was being carried out in accordance with law. Relying upon his representations, assurances, inducement and persuasion, I provided him Number of candidates provided candidates for work abroad, and accordingly transferred Initial payment amount as initial payment on different dates, as demanded by Mr. Main accused's name for initiating the process of work visas.
During the course of my dealings with Mr. Main accused's name, he also issued a job contract letter dated Date of job contract letter, along with a reference number issued by M/s Company name on job contract letter, in favour of the candidates, together with certificates of sponsorship by UK Visas and Immigration for all Number of candidates provided candidates, in order to gain my confidence that the work was genuine and had been processed. He thereafter demanded a further payment of Further payment demanded per candidate per candidate, and relying upon and trusting his representations, I transferred a total of Total amount transferred into joint account into the joint account bearing No. Joint bank account number maintained with Bank name, in the names of M/s First account holder name, Second account holder name and Third account holder name.
Upon every payment, Mr. Main accused's name assured me that the visas were under process and would be issued by the competent authority within two to three months. However, whenever I sought the status of the candidates' visas after every two to three months, he made lame excuses that the Government had changed its policy and that more time and money were required to process the same, and he demanded more and more money on one pretext or another. From Month from which payments continued until today, I have transferred a total of Total amount transferred till date into his joint account.
When, till Month when refund was demanded, no development took place in the visa process, I requested both Both accused's names to kindly return the money of the candidates which had been sent into their joint account, as nothing had been done on their part. They assured me that they would get the work done within a few weeks, but till date neither has any visa been issued to any candidate, nor has their money been refunded to them.
I personally visited Accused's office reference at Accused's office address, Mumbai several times to obtain updates regarding the work, but he always made one excuse or another and continued to deceive me as well as all the Number of candidates provided candidates. I also wrote to him many times on WhatsApp as well as through e-mail regarding the status of the work, but no satisfactory answer was given by him. Till date he is holding the hard-earned money of myself as well as of the candidates.
You are hereby requested to kindly take strict action against all the accused persons and their associates for committing the aforesaid illegal acts under the relevant provisions of law.
Thanking you,
Yours truly,
