IN THE COURT OF Court name; FAMILY COURT; DIST. WEST; TIS HAZARI COURTS, DELHI.
MT. CASE NO. Case number OF 2018.
IN THE MATTER OF :-
Petitioner's name: PETITIONER
VERSUS
Respondent's name: RESPONDENT
N.D.O.H.: Date of next hearing
EVIDENCE BY WAY OF AFFIDAVIT OF THE RESPONDENT (RW1)
AFFIDAVIT OF SH. Deponent's name AGED ABOUT Deponent's age YEARS, S/O SH. Deponent's father's name, R/O Deponent's address, WHO DOES HEREBY SOLEMNLY AFFIRM AND DECLARE AS UNDER:-
1.That I am the Respondent in the above-mentioned case; I am fully conversant with the facts of the case and am competent to swear this present affidavit.
2.I state that the Petitioner herself is guilty of desertion of the Respondent and of the matrimonial home. She made no effort whatsoever to sustain the matrimonial life, with the mala fide intention and ulterior motive of pressurising the Respondent in collusion with her parents and her associates, who misled the Petitioner.
3.I further state that the Petitioner left the company of the Deponent without any reasonable excuse, and that the Petitioner was at all times cruel towards the Deponent and his family members. The Petitioner is suppressing material facts from this Hon'ble Court with mala fide intention.
4.I further state that the Petitioner is a working lady. She is well educated and has also been undertaking tuition work. She has sufficient income every month. The Petitioner is an able-bodied person; she is working and earning, but she is suppressing the true facts from this Hon'ble Court.
5.I further state that the Petitioner failed to perform her duties as the legally wedded wife of the Deponent, yet it is highly surprising that the Petitioner now speaks of the responsibility of the Deponent and his family members. The conduct of the Petitioner conveys a wrong message to society, as the Petitioner is residing with her parents. There is no fault on the part of the Deponent or his family members in respect of the Petitioner leaving the matrimonial home. In fact, the Petitioner herself disturbed the matrimonial life by means of false allegations, in collusion with her parents and her associates.

The Deponent made his best efforts to bring the Petitioner back by visiting her parental home, but on every occasion the Petitioner was, and remains, adamant in refusing to return to the matrimonial home and to rejoin the company of the Deponent, on one pretext or another, without realising the consequences of her acts and deeds.
7.I further state that during the pendency of the present case, the Deponent filed an application under Section 127 Cr.P.C. on the basis of changed circumstances, as the Deponent succeeded in obtaining the details of the entire work experience of the Petitioner from her current employer, Petitioner's current employer.
