MOST RESPECTFULLY SHOWETH-:

    1. That the above noted case was decided by this Hon’ble on XX.XX.XXXX and whereas the case was decided in favor of accused & the accused got acquittal by this Hon’ble Court and the surety was discharged.

      2. That the applicant stood surety for the accused XXXXXXXXX and deposit a fixed deposit of Rs .XX,XXX/- in terms of surety was made as per the directions of this Hon’ble Court.

    3. That the above noted case was decided in favor of accused and it is also important to mention here that the accused has been acquitted in the above mentioned case and surety is also entitled to be discharged as there is no purpose left to remain the surety.

    4. That the applicant could not get the surety released from this hon’ble and filing this application for release/cancellation of surety and the applicant came to know that the above mentioned file is consigned in the record room vide Ghoswara no.XXX/XX.

It is, therefore, prayed to the Hon’ble court to bring the file from the record room and pray for the release/cancel the surety of applicant and may release the surety with the fixed deposit of Rs. XX,XXX/-in the interest of justice.
