On June 27, 1990, we approved in part and disapproved in
part the ethics policy adopted by the Department of Fish and Game
on August 10, 1989.
1990 Inf. Op. Att'y Gen. (June 27;
663-88-0174). Since then, we have worked with your department on
revisions to the policy.
Now, pursuant to your May 7, 1991,
request, we have reviewed the June 1, 1991, version of the policy
for conformity with the Executive Branch Ethics Act, AS 39.52.
You have adopted the policy under AS 39.52.920, which
provides:
Subject to the review and approval of the
attorney general, an agency may adopt a written
policy that, in addition to the requirements of
this chapter, limits the extent to which a public
officer in the agency or an administrative unit of
the agency may
(1)
acquire a personal interest in an
organization or financial interest in a business or
undertaking that may benefit from official action
taken or withheld by the agency or unit;
(2) have a personal or financial interest in
a
state
grant,
contract,
lease,
or
loan
administered by the agency or unit; or
(3) accept a gift.
All the provisions of your June 1, 1991, ethics policy
reflect the actual requirements and prohibitions of the Ethics Act
itself, or fall within the scope of what each agency is allowed to
elaborate upon in a policy, as described in AS 39.52.920.
The
problems with your August 10, 1989, policy have all been adequately

Therefore, we approve your June 1, 1991, ethics policy
under AS 39.52.920.
