Hall, Director Division of Insurance BULLETIN B 10-08 TO: ALL INSURERS WRITING LIFE, ANNUITY, OR HEALTH INSURANCE IN ALASKA AND OTHER INTERESTED PARTIES RE: REPEAL OF REGULATORY ORDER 83-1 RELATING TO EXEMPT FILINGS Regulatory Order 83-1 exempts specified life and health forms from filing and approval requirements under AS 21.42.120. AS 21.42.120(d) authorizes the director to exempt a form from filing if the director determines that filing and approval of the form is not desirable or necessary for the protection of the public. Since 1983 when the order was issued, new products have been designed and issued and the list of products exempted from filing in Order 83-1 is out-of-date. Therefore, by Order R 10-04, dated October 14, 2010, the director has repealed Order 83-1 effective January 1, 2011. A copy of Order R 10-04 is enclosed with this bulletin. Beginning January 1, 2011, all new or revised life and health forms must be filed in compliance with AS 21.42.120 and 3 AAC 31.200 - 3 AAC 31.250. Forms that were not filed with the division before January 1, 2011, pursuant to regulatory Order 83-1, are not required to be filed for approval unless those forms are amended. If a new or modified application, endorsement, rider, or amendment is filed with the division for approval on or after January 1, 2011 and the application, endorsement, rider, or amendment is to be used with a base form that was not previously filed for approval pursuant to Order 83-1, that base form and all other applications, endorsements, or riders that may be used with that form must also be filed. Please note that the repeal of Order 83-1 means that the listing of exempt forms and certifications that were required to be filed under the order no longer need to be filed.
