Dear Mayor Schaffer: Reference is made to your request for an opinion from the Attorney General on the following matter: Is it legal for the Town of Brookside, Alabama, to install and maintain street lights in a mobile home park, where the streets have not been dedicated to the Town of Brookside, Alabama? Your question is to be answered in the negative. It is the opinion of the Attorney General that it would be a violation of Section 94 of the Constitution of Alabama 1901 for the Town of Brookside to provide street lights for undedicated streets in a mobile home park. Section 94 prohibits a municipality from giving money or a thing of value in aid of a private person, corporation or association.
