City Board of Education may
convey property to non-profit
organization in return for
adequate consideration
Dear Mr. Batts:
I am responding to your request for an opinion from
the Attorney General as to whether the Athens City School
Board has the authority under Code of Alabama 1975, Section
16-11-12 to convey certain school board real property as
described in your letter for a nominal consideration to a
non-profit organization.
It is the opinion of the Attorney General that the
Board of Education may convey the property belonging to it
as described in your letter under Section 16-11-12 but this
property cannot be transferred for a nominal consideration.
As stated in a prior opinion to the Honorable W. Johnson
McCall, City Attorney of the City of Thomasville,and an
opinion of the Attorney General found at the Quarterly Reports
of theAttorney General, Vol. 141, p. 7, reasonable and ad-
equate,Consideration must be received by a Board of Education
in the conveyance of school property. Adequate consideration
means just compensation or the "fair market value."
