Dear Representative Ford: This office has received your opinion request which reads in pertinent part as follows: Gadsden State Junior College is a state institution which is located in the city limits of Gadsden, Alabama. All employees on our campus are now and have been paying a 275 Occupational Tax. My question is - can the City of Gadsden maintain our roads and dormitory parking lot on the GSJC campus? By maintaining, I am re- ferring primarily to resurfacing the roads and dormitory parking lot. It is assumed that Gadsden State Junior College, a state institution, serves residents of the City of Gadsden. Your question is, therefore, to be answered in the affirmative. Rep. Joe M. Guntharp, Mayor of Decatur, under date of March 17, 1972, a copy of which is enclosed, this office held that a municipal government may contribute funds and personal property to a state technical junior college and a state technical school when these in- stitutions serve the residents of the city. Therefore, it is the opinion of this office that the City of Gadsden may maintain the roads, regardless of whether they are dedicated and accepted public roads, and dormitory parking lot on the Gadsden State Junior College campus.
