provided in Act #202, 1976 Acts,
page 217.
Dear Ms. Thomas:
Your request of March 3, 1978 has been received wherein you
request an official opinion upon the following question:
"Is the Probate Judge of Blount County entitled
to the fees relating to the chairmanship of the
county commission in addition to the salary as
Probate Judge?"
Act #202, 1976 Acts, page 217 establishes the salaries for the
Probate Judge, Tax Assessor and Tax Collector for Blount County
pending the passage of Amendment #344 to the Constitution of
Alabama 1901, which amendment was proclaimed ratified January
22, 1976, and said act became law August 6, 1976.
This Act provides as follows:

"The following officers of Blount County shall
be entitled to receive compensation as follows:
(a) The judge of probate, an annual salary of
$21,500.00
* * * *
Such salaries shall be paid in lieu of all
other compensation heretofore provided by law and
shall be paid in equal monthly installments out of
the general fund in the county treasury."
"All fees, commissions, allowances, percen-
tages, and other charges heretofore collected for
the use of the judge of probate, tax assessor, and
tax collector, hereafter shall be collected and paid
into the general fund of the county."
The salary prescribed in Act 76-202 is the total compensation to be received
by the Probate Judge according to the specific language of the
statute.
