Box 280 Ozark, Alabama 36360 Dale County - County not authorized to provide lighting for streets in private rural subdivision Dear Mr. Adams: Your request of September 29, 1978, pertaining to the expense of lighting streets in a rural subdivision, has been received and researched. Your question must be answered in the negative. The County Commission of Dale County is prohibited from lending its credit, or granting public money or things of value to individuals or private entities as is directed in the Constitution of Alabama 1901, Section 94. There is no indication that the street lighting is in any manner a part of the construction process, nor it it for the benefit of other than the property owners and developers of the subdivision. No authority can be found which would authorize such an expenditure neither for the installation nor the maintenance of same.
