Dear Sir: This letter is in response to your letter of recent date which asked whether the Bibb County Commission may use county owned machinery bought with gasoline tax revenue to install water lines in rural areas of the county. Your question is answered in the negative. Amendment 93 of the Constitution of Alabama 1901, states that no gasoline tax monies "shall be expended for other than cost of administering such laws, statutory refunds and adjustments allowed therein, cost of construction, re-construction, maintenance and repair of public highways and bridges, cost of highway rights- of-way, payment of highway obligations, the cost of traffic regulation, and the expense of enforcing state traffic and motor vehicle laws." It is my opinion that the use of county machinery purchased with gasoline tax revenue for the installation of water lines in rural areas of Bibb County would conflict with the provisions of Amendment 93, supra.
