Desmond, Chairman Bibb County Commission Room 15, Community Activity Building 103 Davidson Drive Centreville, Alabama 35042 Bibb County - County Commission Chairman, Bibb County Commission has authority to hire personnel pursuant to Code of Alabama 1975, SS11-8-7 and 11-8-8 Dear Judge Desmond: This office has rendered an opinion pertaining to the question presented by you in your letter of April 6, 1978 which question is as follows: "My question is: Does the Chairman of the Bibb County Commission have the legal autho- rity to employ the clerk of the Bibb County Commission? Since one person holds both titles, I think he should be able to obtain an opinion without a resolution by the Com- mission." In the opinion to Honorable Frank Ellis, Columbiana, Alabama, dated July 22, 1977, copy of which is attached hereto for your information and guidance, it was determined by this office that the chairman of a county commission may hire personnel to per- form the duties required by Title 12, Sections 79 and 80, Code of Alabama 1940 (Recompiled 1958) now codified as Code of Ala- bama, SS11-8-7 and 11-8-8. Therefore, for answer to your question, you, as Chairman of the Bibb County Commission, have the legal authority to employ the clerk or clerks required to perform the duties imposed upon you by the said code sections supra.
