Box 128 Oden, AR 71961 - Dear Mr. Maddox: , You have requested the opinion of this office regarding the following question. Our Municipal Judge in Montgomery County, Mr. Hal Barnes, is resigning effective January 1, 1986. I understand we have one person in Montgomery County eligible to fill this position, a Mr. William McKimm, who had planned to seek the office in the Primary Election of 1986. The question.is: Can Mr. McKimm be appointed to this position and run for re-election in 1986? The answer to this question is yes. There is nothing of which I am aware in State law which prohibits an appointed Municipal Judge in Montgomery County for running for election for the post in the next election.
