Dear Ms. Jones:
This is in response to your request for an opinion on
the following question.
What is the impact, if any, of Ark. Stat. Ann.
§13-1402 (Repl. 1979) on the administration of
Ark. Stat. Ann. §62-1824 (Repl. 1971)?
Ark. Stat. Ann. §13-1402 relates to the jurisdictional
powers of the Arkansas State Claims Commission. Ark. Stat.
Ann. §§62-1823 and 1824 provide means by which a rightful
heir may claim funds that escheated to the state after the
intestate's death,
In the event that the rightful heirs to funds escheated
to the State should file a petition in Circuit Court as
outlined in Ark. Stat. Ann. §62-1823, the State Auditor
would be able to pay as directed in Ark. Stat. Ann. §62-1824
on the basis of the Court Order. There is no conflicting
language between Sections 13-1402 and 62-1823, therefore, they
Can stand separately.
