Dear Mr. Webb:
Deputy Prosecuting Attorney Gary Isbell has requested an opinion from
our office on the following question:
Is there a prohibition under Arkansas law
against the same person being both a non-
law enforcement employee with the sheriff's
office and the Municipal Court Clerk of Marion
County?
’ The request indicates that in addition to being a county employee of
the sheriff's ofice, the person involved is paid a salary by the
county for services as a Municipal Clerk.
Ark. Stat. Ann. §17~4208(3) (a) (1980) prohibits any county officer
or employee from being interested in, or accepting money from,
any contract or transaction of a county. Accordingly, it is our
opinion that the situation described is prohibited by §17-4208(3) (a).
