Asa Hutchinson Governor May 23, 2017 BULLETIN NO.: 6-2017 TO: Allen Kerr Commissioner b • OF ALL ACCIDENT AND HEALTH INSURERS, HEALTH MAINTENANCE ORGANIZATIONS AND HOSPITAL AND MEDICAL SERVICE CORPORATIONS & OTHER INTERESTED PARTIES FROM: ARKANSAS INSURANCE DEPARTMENT SUBJECT: ALTERNATIVE OR DUAL RATE FILINGS IN THE ARKANSAS HEALTH INSURANCE MARKETPLACE The Arkansas Insurance Department issues this Bulletin to address health insurers and HMOs requesting to file alternative or dual rates for review and approval for policies or contracts to be issued through the Arkansas Health Insurance Marketplace for the 2018 plan year. The Arkansas Insurance Commissioner ("Commissioner") does not interpret Ark. Code Ann. §§ 23-79- 109 and 23-79-110 to permit multiple, dual or alternative rate filings for review and approval of a policy. For rates filed for policies or contracts in the Arkansas Health Insurance Marketplace for the 2018 plan year, an insurer or HMO may only submit one rate filing in SERFF for actuarial review and approval for that policy. The insurer or HMO may however submit to the Commissioner alternative rate filings for that policy outside or separate from SERFF for the Commissioner to retain for informational purposes. Such filings will be examined by the Commissioner and his staff. The Commissioner may later allow such alternative filings to be submitted for official review and approval in the event that: (1) federal requirements have changed related to cost sharing reductions or cost sharing requirements, and (2) the Commissioner has sufficient time to review such alternative filings before final approval of rates are required for the 2018 plan year.
