The amendment was effective July 1, 1991. Your attention is directed to Subdivision (B) of §23-67-119(3). You must grant or reject an insured’s request to review the manner in which a rating system has been applied within thirty (30) days. The Department is receiving appeals from insureds whose request to review has not even been acknowledged, much less granted or refused within the time allowed. You must furnish the Department a written transcript of proceedings before you and a written memorandum of your decision. The Department has received appeals from insureds whose reviews were held after the effective date of Act 1123, where written transcripts of the review were not prepared. Pursuant to Arkansas Code Annotated §23-67-105, administrative action will be pursued for future violations of the above referenced Code provision.
