23 CAR § 302-925. Commencement of contested case — Briefs

(a) Briefs may be filed by a party or the State Securities Department either before or during the course of a hearing or within such time as the Securities Commissioner designates. (b) Failure to file a brief shall in no way prejudice the rights of any party or the department. (c) The order of filing briefs or reply briefs shall be designated by the commissioner. (d) The commissioner shall provide the parties and the department at least fourteen (14) days to file a brief after it is requested. (e) A party or the department may request an extension of the briefing schedule set by the commissioner prior to the due date. (f) Late briefs may not be considered by the commissioner.
