27 CAR § 91-705. Right-of-way

(a) A utility facility located on private right-of-way or easement (outside the existing highway right-of-way) is considered to be eligible for reimbursement of the cost of replacement right-of-way. (b) Copies of an easement or affidavit verifying the utility owner's right of occupancy must be submitted with the relocation proposal. (c) There will be no charge to the Arkansas Department of Transportation for that portion of the utility owner's existing private right-of-way or easement being transferred to the department for highway purposes.
