8 CAR § 11-202. Director as permitting authority

(a) The Director of the Division of Environmental Quality or the director’s delegatee shall issue all permits. (b) Nothing in this part, including the power to reverse or affirm a permitting decision by the director, shall be construed to authorize the Arkansas Pollution Control and Ecology Commission to issue a permit.
