8 CAR § 42-704. Emissions trading allowed under 8 CAR pt 41

(a)(1) A permitted part 70 source may trade increases and decreases in emissions within the permitted facility, where 8 CAR pt. 41 provides for such emissions trades without requiring a permit revision. (2) The permittee shall provide seven (7) days’ written notice to the Division of Environmental Quality which shall state: (A) When the proposed change will occur; (B) A description of such change; (C) Any change in emissions; (D) The permit requirements with which the source will comply using the emissions trading provisions of the State Implementation Plan; and (E) The pollutants emitted subject to the emissions trade. (3) The notice shall also refer to the provisions with which the source will comply in the State Implementation Plan and that provide for the emissions trade. (b) The permit shield described in Subpart 6 of this part shall not extend to any change made pursuant to this section. (c) Compliance with the permit requirements that the source will meet using the emissions trade shall be determined according to requirements of the State Implementation Plan authorizing the emissions trade.
