8 CAR § 60-707. Disposal of spent pesticide and herbicide containers

(a) Applicability. No person shall dispose of any pesticide or herbicide containers, or any residue therefrom in a manner inconsistent with its labeling or intended use, or in violation of 40 C.F.R. § 261.7(b)(3) or state pollution control or plant board standard.
(b) Triple rinsing.
(1) Containers must first be triple-rinsed with at least fifteen percent (15%) of the volume of the container, using rinse water as makeup whenever possible.
(2) Salvageable containers may then be returned to the manufacturer or formulator, or a drum reconditioner for reuse.
(3) Nonsalvageable, triple-rinsed containers may then be crushed and transported to a Class 1 landfill for disposal.
(c) Container residue.
(A) Container residue and rinse water should be added to application mixes in the field whenever possible.
(B) If not, they must be disposed of in accordance with manufacturers' label instructions.
