9 CAR § 40-759. Medicaid and financial issues

(a) Before a youth is placed in an out-of-state treatment facility due to an emotional disturbance, the Office of Chief Counsel will make and document the following determinations as required by Arkansas Code § 20-46-106 via Out of State Placement Request, which will then be reviewed with the Specialized Placement Unit (SPU) Manager. (b) If a youth in Division of Children and Family Services custody is placed in an out-of-state placement without proper documentation, Medicaid will not approve a certification of need and authorization to pay the provider or facility for services will be refused. (c) The information collected by the above determinations shall be included in the youth’s case file. (d) The information shall be reviewed and considered by the juvenile judge.
