ER 8.3. Reporting Professional Misconduct

(a) A lawyer who knows that another lawyer has committed a violation of the Rules of Professional Conduct that raises a substantial question as to that lawyer's honesty, trustworthiness or fitness as a lawyer in other respects, shall inform the appropriate professional authority, except as otherwise provided in these Rules or by law. (b) A lawyer who knows that a judge has committed a violation of applicable rules of judicial conduct that raises a substantial question as to the judge's fitness for office shall inform the appropriate authority, except as otherwise provided in these Rules or by law. (c) A lawyer who knows that a legal paraprofessional or certified Alternative Business Structure entity has committed a violation of the applicable codes of conduct that raises a substantial question as to the person or entity's compliance with the codes shall inform the appropriate authority. (d) This Rule does not require disclosure of information otherwise protected by ER 1.6. (e) This Rule does not require disclosure of information about another lawyer or a judge as a result of participation in an approved lawyer assistance program. A lawyer shall not disclose that information except as permitted by rules applicable to the program or by law.
