RE: Long Term Care Insurance Regulation Effective Date; A.A.C. R20-6-1019(L)
On November 2, 2004 the Governor’s Regulatory Review Council approved amendments to the Arizona Administrative
Code, Title 20, Commerce, Banking, and Insurance, Chapter 6, Department of Insurance, Article 10, Long Term Care
Insurance. The Department filed the rulemaking with the Secretary of State’s Office for publication on November 4, 2004.
The rulemaking more closely conforms the Arizona rules to the NAIC Long Term Care Insurance Model Regulation
(Model Regulation), with minor changes necessitated by other Arizona laws. The purpose of this Bulletin is to clarify
questions regarding the effective date of A.A.C. R20-6-1019(L) of the amended rules.
Although the effective date of the rulemaking under the Arizona Administrative Procedures Act would ordinarily be two
months after filing (January 10, 2005), to be consistent with the NAIC Model Regulation, this rulemaking must have an
effective date 12 months after the rulemaking (November 10, 2005). Accordingly, A.A.C. R20-6-1019(L) identifies the
controlling effective date as follows: “The requirements in this Section are effective on or after November 10, 2005….”
