Cohen Director of Insurance DATE: June 29, 2001 RE: Notification of Rulemaking Activities A.R.S. § 41-1022(C) requires the Insurance Department to give notice to persons who have requested notification of pending rulemaking proceedings whenever the Department files a notice of proposed rulemaking. The statute permits the Department to provide the notice by several different means, including use of a periodic newsletter. In circular letter 1998-6, the Department indicated that it would compile a mailing list for this purpose, and requested that interested parties advise the Department of the desire to be included on the mailing list. At that time, the Department did not publish a periodic newsletter. The Department now publishes a quarterly newsletter that includes information on pending rulemaking activities. By this bulletin, the Department advises interested parties that the quarterly newsletter will serve to give notice of rulemaking activities as required by A.R.S. § 41-1022(C). Circular letter 1998-6 is repealed. The newsletter is mailed to Department stakeholders and is available on the Department’s web site at www.state.az.us/id. Any person who has previously requested rulemaking notice who does not already receive the Department’s quarterly newsletter may notify Kathy Linder at 602/912-8456 and request to be added to the newsletter distribution list.
