R9-25-506. Protocol for Requesting Authorization to Register Under the Protecting Patient Access to Emergency Medications Act of 2017

A. Under A.R.S. § 36-2205, the Department may authorize an emergency medical services provider to register with the U.S. Drug Enforcement Administration pursuant to the Protecting Patient Access to Emergency Medications Act of 2017 according to 21 CFR Parts 1300, 1301, 1304, 1306, and 1307. B. To request authorization according to subsection (A), an emergency medical services provider, including an ambulance service, shall submit to the Department: 1. The following information, in a Department-provided format: a. The name of the emergency medical services provider; b. Any other names by which the emergency medical services provider is known; c. Whether the emergency medical services provider is a: i. Governmental entity, including the type of governmental entity; or ii. Business organization; d. The physical address, mailing address if different, email address, and telephone number of the emergency medical services provider; e. If the emergency medical services provider is an ambulance service regulated under Article 9 of this Chapter, the identifying number on the ambulance service’s current certificate of necessity; e. The name, email address, telephone number, and professional license number of the physician providing administrative medical direction on behalf of the emergency medical services provider; and f. The signature and date of signing of the individual authorized according to R9-25-102 to sign on behalf of the emergency medical services provider; and 2. An attestation from the physician designated, according to R9-25-201(A)(2), by the emergency medical services provider to provide administrative medical direction that includes: a. The physician’s name and professional license number; b. The name of the emergency medical services provider for which the physician provides administrative medical direction; c. A statement that the physician provides administrative medical direction, according to R9-25-201, to the emergency medical services provider’s EMCTs who provide ALS; and d. The physician’s signature and date of signing. C. The Department shall, within seven days after a written request for authorization for an emergency medical services provider to obtain a registration with the U.S. Drug Enforcement Administration for controlled substances in subsection (B): 1. Approve the request if the request complies with subsection (B), and 2. Send written notification of approval to the emergency medical services provider making the request. D. An emergency medical services provider, including an ambulance service, shall submit to the Department: 1. A new attestation, according to subsection (B)(2), within 10 days after a change in the physician designated, according to R9-25-201(A)(2), by the emergency medical services provider to provide administrative medical direction; and 2. A new request for authorization to register with the U.S. Drug Enforcement Administration within 30 days after a change of ownership. E. The Department may notify the U.S. Drug Enforcement Administration that the Department is withdrawing authorization of an emergency medical services provider if the Department learns of: 1. A change in the physician designated by the emergency medical services provider to provide administrative medical direction, and a new attestation is not received by the Department, according to subsection (D)(1); 2. A change in ownership, and a new request for authorization to register with the U.S. Drug Enforcement Administration is not received by the Department, according to subsection (D)(2); or 3. Issues involving the emergency medical service provider’s obtaining, storing, transferring, or disposing of controlled substances.
