R14-2-1003. Grant of Certificate of Convenience and Necessity

A. The Commission shall analyze an application for a certificate of convenience and necessity (“CC&N”) to determine if it is complete and correct. If necessary, the Commission may request additional information from the CC&N applicant. B. The Commission shall hold a hearing to determine whether it is in the public interest to grant a CC&N to the applicant. C. The Commission shall notify in writing the CC&N applicant and the appropriate LECs of the Commission’s determination made pursuant to this Section. A CC&N granted under this Section shall be issued in the name of the AOS provider. D. All CC&Ns granted under this Section shall include both of the following: 1. An obligation to serve all end-users and subscribers in a nondiscriminatory manner, and 2. An obligation to comply with all Commission requirements relevant to the provision of telecommunications service.
