R17-1-508. Motion Practice

A. A party or a party’s attorney making a motion shall state in the motion the relief sought, the factual basis, and the legal author- ity for the requested relief. 1. For a pre-hearing motion, a party or a party’s attorney shall: a. Make the motion in writing, and b. File the motion with the Executive Hearing Office at least five business days before the administrative hearing. 2. For a motion made at an administrative hearing: a. A party or a party’s attorney may make the motion orally, and b. The administrative law judge may require the party or the party’s attorney to file the motion in writing. B. An administrative law judge may include a ruling on a motion in an administrative hearing decision.
