R18-13-202. Coal Slurry Discharges from Pipeline Leaks Exemption

This Section applies only to coal slurry discharges onto the ground from pipeline leaks. Coal slurry discharges onto the ground from pipeline leaks are exempt statewide from the definition of solid waste prescribed in A.R.S. § 49-701.01(A) if both of the following conditions are met: 1. The discharge was the result of an accidental pipeline leak. 2. The thickness of the layer of coal slurry on the ground that resulted from the discharge is 3 inches or less.
