Cal. HSC § 13142.8

When the board sits as a board of appeals: (a) The State Fire Marshal shall not sit as a member of the board. (b) A member of the board shall not sit as a member or participant in the decision of any particular appeal if that member has a financial or other interest which would influence his or her decision on the particular appeal.
