Exemption from construction standards

As provided by Section 25-133 of the General Statutes, as amended, where the Board finds that compliance with the regulations and construction standards adopted herein would result in undue hardship, an exemption from any one or more of the standards may be granted by the Board to the extent necessary to ameliorate such undue hardship, and to the extent such exemption can be granted without impairing the intent and purpose of the regulations. An application for a special exemption shall be made at the office of the Board, and shall be in writing on a form to be supplied by the Board. The application shall include all information regarding circumstances and conditions of construction of the well as the Board deems necessary. The decision of the Board to grant or deny the exemption requested, in whole or in part, shall be made within thirty (30) days, and the Board shall notify the applicant by certified mail of its decision.
