The following requirements shall apply where a CHFA mortgage loan is secured by a mortgage on a leasehold interest: (a) the lease shall be in full force and effect; (b) the notice of lease shall be recorded on the land records of the town in which the leased property is located; (c) the term of the lease may not terminate earlier than that number of years beyond the maturity date of the CHFA mortgage loan as is equal to the number of years remaining to maturity; and (d) the lease shall be in a form acceptable to the participating lender and CHFA; it shall provide that the lessee may mortgage the leasehold estate, and that the lease may not be terminated for a lessee's default unless the mortgage receives from the lessor written notice of, and reasonable opportunity to cure, such default.
