Procedure to submit to parties

Where a majority of the commissioners have not heard a contested case or read the
record thereof, any decision adverse to a party other than the commission, itself,
shall not be made until such decision is served as a proposed decision upon each of
the parties and until each party adversely affected thereby is afforded an opportunity
to file exceptions and to present briefs and oral argument to the commissioners. Such
proposed decision shall contain a statement of the reasons therefore and of each issue
of fact or law necessary to the proposed decision, which statement shall have been
prepared by the presiding officer or by a commissioner who has read the record of
the hearing. By written stipulation the parties may waive compliance with this section
of these rules.
