6302. SECONDARY TIER VIOLATIONS

6302 SECONDARY TIER VIOLATIONS 6302.1 The Board may fine a licensee for a secondary tier violation at a show cause hearing as follows: (a) For the first secondary tier violation, $250-$500; (b) For the second secondary tier violation within two (2) years, $500-$750; (c) For the third secondary tier violation within three (3) years, $750-$1,000; and (d) A licensee found in violation of a secondary tier violation for the fourth time within four (4) years shall be penalized according to a first primary tier violation ($1,000-2,000). Every subsequent secondary tier offense within five (5) years of the first violation shall be fined according to the schedule for primary tier violations.
