3407 INFRACTIONS 3407.1 Failure to comply with excavation notification requirements found at D.C. Official Code § 34-2704 is a Class 1 infraction pursuant to the Department of Consumer and Regulatory Affairs Civil Infractions Act of 1985, effective October 5, 1985 (D.C. Law 6-42; D.C. Official Code § 2-1801.01, et seq.), and 16 DCMR §§ 3200 and 3201. 3407.2 Failure to comply with requirements for identifying and marking underground facilities pursuant to §§ 3407.1 and 3407.2 is a Class 1 infraction pursuant to the Department of Consumer and Regulatory Affairs Civil Infractions Act of 1985, effective October 5, 1985 (D.C.
