2105 EX PARTE COMMUNICATIONS 2105.1 Hearing examiners shall not engage in ex parte communications with any individual, including any official, employee, agent, or counsel of the Department. 2105.2 Where a hearing examiner has engaged in ex parte communications, the hearing examiner shall disclose such communications on the record, and shall consider whether recusal is required by § 2104.1.
