400. AMENDMENT TO CREATE A NEW ZONE

AMENDMENT TO CREATE A NEW ZONE Petitions for the creation of a new zone shall be consistent with the conditions of this section. The new zone shall be for a well-defined geographic area with generally similar development characteristics and land use. Proposed new zones shall not be inconsistent with the Comprehensive Plan or with applicable small area plans. Proposed new zones shall not result in adverse impacts on the environment or adjacent lands. Proposed new zones shall not result in the undue diminution of property rights. Petitions for a new zone shall be accompanied by the following: Evidence of significant community support for the zone including property owners within the defined area, relevant civic, community and business groups, and the Advisory Neighborhood Commission, including the single member district representation; and Surveys, plats, maps, scaled elevations, or similar information documenting any proposed changes to applicable development standards; Petitioners are encouraged to inquire with the Office of Planning about available public resources. If the proposed new zone involves a reduction in any development standard or property right, an effected property owner in opposition shall be given an equal amount of time as the petitioner to present their opposition.
