Suspending Annual Requirement for Delivering Annual Statement to the Department of Insurance

Karen Weldin Stewart, CIR-ML Commissioner Delaware Department oflnsurance TO: RE: DOMESTIC/FOREIGN INSURERS BULLETIN NO. 68 ALL FOREIGN AND ALIEN INSURERS LICENSED IN DELA WARE SUSPENDING ANNUAL REQUIREMENT FOR DELIVERING ANNUAL STATEMENT TO THE DEPARTMENT OF INSURANCE DATED: November 19, 2013 Pursuant to 18 Del. C. §526(a), all authorized insurers are required to file annually with the Department a full and true statement of its financial condition, transactions and affairs as of December 31 preceding. Except as set forth in the immediately succeeding sentence, the Department is suspending this requirement with respect to foreign and alien insurers licensed in Delaware. Effective immediately, each foreign and alien insurer authorized to transact business in this State shall only be required to submit to the Department such insurer’s signed jurat page for its annual statement, which jurat page shall be submitted electronically to DOI_AnnualStatement@delaware.gov. With respect to such electronic submissions, each insurer shall label the electronic submission (i.e. the subject line) using the following format: [Year of Filing] NAIC [Insurer’s NAIC #] (Example: 2013 NAIC #12345). Foreign and alien insurers are still subject to the requirements of 18 Del. C. §526(e), which requires all insurers authorized to transact business in this State to file their annual statements with the NAIC. The Department may request that a foreign or alien insurer provide a copy of any annual statement filing made by such insurer with the NAIC. This bulletin shall not affect the obligations of Delaware-domestic insurers under 18 Del. C. §526(a). This Bulletin shall be effective immediately. ---- .
