On May 5, 1942, the National Lahor Relations Board issued its
Decision and Direction of Elections 1 in the above-entitled proceed-
ings.
Pursuant to the Direction of Elections, elections by secret bal-
lot were conducted on May 28 and June 2, 1942, under the direction
and supervision of the Regional Director for the Thirteenth Region
(Chicago,. Illinois)
On June 8, 1942, the Regional Director, acting
pursuant to Article III, Section 9, of National Labor Relations Board
Rules and Regulations-Series 2, as amended, issued and duly served
upon the parties an Election Report
No objections to the conduct
of the election or the Election Report have been filed by any of the
parties

Since the counting of the challenged ballots could not affect the
result of the election, we find it unnecessary to make any determina-
tion of the challenges.
By virtue of and pursuant to the power vested in the National
Labor Relations Boaid by Section 9 (c) of the National Labor Rela-
tions Act, 49 Stat 449, and pursuant to Article III. Sections 8 and
9, of National Labor Relations Board Rules and Regulations-Series
2, as amended,
IT IS HEREBY CERTIFIED that Oil Woikeis International Union, Local
463, affiliated with the Congress of Industrial Organizations, has been
designated and selected by a majority of all production and main-
tenance employees of Texoma Natural Gas Company in its gasoline
and compressor station plants at Fi itch, Texas, excluding supervisory,
clerical, and laboratory employees, and employees in the pipe-line and
communications departments, as their representative for the pur-
poses of collective barganung, and that, pursuant to the provisions
of Section 9 (a) of the National Labor Relations Act, Oil Workers
International Union, Local 463, affiliated with the Congress of Indus-
trial Organizations, is the exclusive representative of all such em-
ployees for the purposes of collective bargaining with respect to rates
of pay, wages, hours of employment, and other conditions of employ-
ment

Since the counting of the challenged ballots could not affect the
result of the election, we find it unnecessary. to make any deteintma-
tion of the challenges.
The results of the election show that no collective bargaining iep-
resentulve has been selected by a majority of the employees of the
Co nl)any in the unit heretofore" found to be appropriate foi collec-
tive bargaining
We shall, therefore, dismiss the petition for inves-
tigation and ceitification of representatives of employees of the
Company

By virtue of and puisuant to the power vested in the National
Labor Relations Board by Section 9 (c) of the National Labor Rela-
tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and

IT Is IHE1iEBY ORDERED that the petition for investigation and certifi-
cation of representatives of employees of Natural Gas Pipe Line
-Company of-America, Chicago, Illinois, filed by International Union
of Operating Engineeis, Local 259, affiliated with the A F of L, be,
and it hereby is, dismissed
