R-947 to R--951, inclusive, respectively CERTIFICATION OF REPRESENTATIVES February 24, 1939 On December 14, 1938, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Elections 1 and on January 5, 1939, issued an Amended Decision and Direction of Elections 2 in the above-entitled cases. The Direction of Elections, as amended, provided that separate elections by secret ballot be con- ducted (1) among all the production and maintenance employees of Donovan Lumber Company in its Mills Nos. 1 and 2, on the pay roll in Mill No. 1 on July 9, 1937, and on the pay roll in Mill No. 2 on October 20, 1937, excluding clerical employees, foremen and super- visory employees of higher rank, employees of independent contrac- tors operating in the mills, and those who had since quit or been discharged for cause, to determine whether they desired to be repre- sented by Local No. 2, Sawmill and Timber Workers Union, Inter- national Woodworkers of America, affiliated with the Committee for Industrial Organization, or by Local No. 2762, Lumber and Sawmill Workers Union, United Brotherhood of Carpenters and Joiners of America, affiliated with the American Federation of Labor, for the purposes of collective bargaining, or by neither; (2) among all the production and maintenance employees of Bay City Lumber Com- 110 N. 1. 1, 1, 6;9 TO N. B, No. 5v. 164275-39-voI xi--47 725 726 DECISIONS OF NATIONAL LABOR RELATIONS BOARD pany on its pay roll on November 3, 1937, excluding clerical employees, foremen and supervisory employees of higher rank, em- ployees of independent contractors operating in the mill, and those who had since quit or been discharged for cause, to determine whether they desired to be represented by Local No. 2, Sawmill and Timber Workers Union, International Woodworkers of America, affiliated with the Committee for Industrial Organization, or by Local No. 2783, Lumber and Sawmill Workers Union, United Brotherhood of Carpenters and Joiners of America, affiliated with the American Federation of Labor, for the purposes of collective bargaining, or by neither; (3) among the production and maintenance employees of Schafer Brothers Logging Company in its sawmill No. 4 and among the employees in its logging camps, including the logging railroad employees on its pay roll on the date operations ceased in October 1937, but excluding clerical employees, foremen and supervisory em- ployees of higher rank, boom men, tugboat operators, shingle weavers, timber cruisers, lath mill employees, and those who had since quit or been discharged for cause to determine whether they desired to be represented by Local No. 2, Sawmill and Timber Workers Union, International Woodworkers of America, affiliated with the Com- mittee for Industrial Organization, or by Local No. 2782, Lumber and Sawmill Workers Union, United Brotherhood of Carpenters and Joiners of America, affiliated with the American Federation of Labor, for'the purposes of collective bargaining, or by neither; (4) among all the production and maintenance employees of Grays Harbor Lum- ber Company on its pay roll of May 4, 1938, in its plant at Hoquiam, Washington, excluding clerical employees, and foremen and super- visory employees of higher rank, and excluding those who had since quit or been discharged for cause, to determine whether they desired to be represented by Local No. 2888, Lumber and Sawmill Workers Union, United Brotherhood of Carpenters and Joiners of America, affiliated with the American Federation of Labor, or by Local No. 2, Sawmill and Timber Workers Union, International Woodworkers of America, affiliated with the Committee for Industrial Organization, for the purposes of collective bargaining, or by neither; and (5) among all the production and maintenance employees of Anderson & Middleton Lumber Company on its pay roll of November 17, 1937, in its mill at Aberdeen, Washington, excluding clerical employees, foremen and supervisory employees of higher rank, employees of all the independent contractors working in the plant, and those who had since quit or been discharged for cause, to determine whether they desired to be represented by Local No. 2, Sawmill and Timber Workers Union, International Woodworkers of America, affiliated with the Committee for Industrial Organization, or by Local No. 2778, Lumber and Sawmill Workers Union, United Brotherhood of DONOVAN LUMBER COMPANY ET AL. 727 Carpenters and Joiners of America, affiliated with the American Federation of Labor, for the purposes of collective bargaining, or by neither: Pursuant to the Direction of Elections, as amended, separate elec- tions by secret ballot were conducted on January 19 and 20, 1939, under the direction and supervision of the Regional Director for the Nineteenth Region (Seattle, Washington). Full opportunity was afforded all parties to the investigations to participate in the conduct of the secret ballots and to make challenges. On January 25, 1939, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 1, as amended, issued Intermediate Reports on the elections and on January 26, 1939, duly served said Intermediate Reports upon the parties. No objections or exceptions to the Intermediate Reports have been filed by any of the parties.
